On 16 May 2019, the State Administration for Market Regulation and the Ministry of Industry and Information Technology officially issued the Implementation Rules for the Conformity Assessment System for Restriction of Hazardous Substances in Electrical and Electronic Products (hereinafter referred to as the Implementation Rules). Products included in the Catalogue of Products Subject to Compliance Administration for Restriction of Hazardous Substances in Electrical and Electronic Products (First Batch) (click the blue link for details) that are manufactured or imported on or after 1 November 2019 shall comply with the requirements of the Implementation Rules.

      The main requirements of the Implementation Rules for conformity assessment activities of products within the Compliance Administration Catalogue are as follows:

·        Conformity assessment methods:  For electrical and electronic products covered by the Compliance Administration Catalogue, enterprises shall adopt either China’s National Voluntary Certification or Supplier’s Declaration of Conformity to complete the conformity assessment on restriction of hazardous substances. The publication of conformity assessment information and results is managed via the public service platform.

·        National Voluntary Certification:  In accordance with the Implementation Rules for Voluntary Certification of Restriction of Hazardous Substances in Electrical and Electronic Products, enterprises may select an applicable certification mode for the products applying for certification. After passing sample testing and factory inspection evaluation, the certification body issues a certification certificate and uploads certification information to the public service platform within 5 working days.

·        Supplier’s Declaration of Conformity: In accordance with the Rules for Supplier’s Declaration of Conformity for Restriction of Hazardous Substances in Electrical and Electronic Products, manufacturers or authorized representatives shall submit compliance information on the public service platform within 30 days after placing products on the market.

·        Conformity assessment marking:  The marking requirements refer to the Measures for the Administration of the Use of Green Product Marks.

Pattern 1 (National Voluntary Certification) Pattern 2 (Supplier’s Declaration of Conformity)

·        Supervision and administration: Market regulation authorities and industry & information technology authorities at all levels, together with relevant departments, shall supervise and administer conformity assessment activities and results. The State Administration for Market Regulation and the Ministry of Industry and Information Technology investigate and handle reports on violations of these rules. Relevant authorities impose penalties for irregularities and publicly disclose corporate administrative penalty information through the National Enterprise Credit Information Publicity System and the public service platform in accordance with law.
